Paternity leave and pay, plainly
What you are entitled to in the UK, what you have to do to get it, and the deadlines that catch people out.
Dull, and worth twenty minutes of your attention, because the deadlines are real and missing them costs you weeks with your child.
Rules change. Treat this as the map, then check official guidance and your own contract for the current detail. This is general information, not personalised legal advice. The distinction between leave and pay below was updated on 21 September 2026 using the linked government sources.
Statutory paternity leave
Leave and pay have different eligibility rules. In England, Scotland and Wales, paternity leave became a day-one employment right on 6 April 2026, subject to the other eligibility and notice requirements. This change does not apply in Northern Ireland. Check the official explanation of the April 2026 changes for the geographical scope.
The entitlement is up to two weeks, together or in separate one-week blocks. Statutory Paternity Pay still has service and earnings conditions; qualifying for leave does not automatically mean qualifying for pay. Read the GOV.UK eligibility rules and current payment rules before budgeting.
Two things people get wrong:
- The notice deadline is earlier than you think. Typically around the fifteenth week before the due date. Diarise it.
- Your employer may offer more than statutory. Ask HR for the written policy rather than assuming the legal minimum.
Shared parental leave
If eligible, you and your partner can divide up to fifty weeks of leave and thirty-seven weeks of pay between you, in blocks, and you can be off at the same time or take turns.
Eligibility and notice requirements matter. The amount available also depends on how much maternity or adoption leave and pay has already been used. Check the Shared Parental Leave and Pay guidance together before arranging blocks with your employers.
The pattern that suits many families: you take your two weeks at the birth, then a separate block later when she returns to work. Two weeks at the start is a blur. Four weeks alone with a six-month-old changes your relationship with your child permanently.
Unpaid parental leave and flexible working
Separate to the above, you can request flexible working, and there is a right to unpaid parental leave for children under eighteen. Requests must be considered properly and cannot simply be ignored.
A short checklist
- Ask HR for the written paternity and shared parental policy. In writing.
- Note the notice deadline in your calendar with a fortnight of warning.
- Run the gov.uk shared parental leave calculator with your partner, once, together.
- Work out the household budget for the leave period before you commit to it.
- Book the leave, then tell your team, then hand over properly. In that order.
The part that is not paperwork
Take everything you are entitled to. Nobody at your funeral will mention the quarter you protected by cutting your leave short, and the first months genuinely happen only once.
